What is SB-34?
SB-34 (the Dennis Peron and Brownie Mary Act) allows licensed California cannabis businesses to donate free medicinal cannabis to qualified medical patients — either directly (by a retailer) or through donations from licensees to retailers for subsequent donation to patients.
Who qualifies
Qualified medical cannabis patients in California — and their caregivers.
Under SB-34, compassion products may only be donated to qualified medical patients. You qualify if you have either of the following:
- A current physician’s recommendation for medical cannabis, or
- A state Medical Marijuana Identification Card (MMIC/MMID)
Caregivers may pick up on a patient’s behalf with documentation showing they are that patient’s caregiver.

What to bring
- Physician recommendation + a government-issued photo ID, or
- MMIC/MMID card + a government-issued photo ID
- Caregivers: documentation that you are the patient’s caregiver + your photo ID (the store may request additional proof)
- Some retailers ask for a medical diagnosis to better help them assist you in their compassion program
How the program works
Program compliance disclosure
- Products are donated in accordance with SB-34 and may only be distributed to qualified medical patients.
- Donations are not for resale and cannot be exchanged or transferred.
- Availability may vary by location and supply.
- Participating retailers reserve the right to establish additional verification procedures consistent with state law.
- All cannabis products are laboratory tested in compliance with California regulations.
